Terms of Service

These Terms of Service ("Terms") govern your use of Upload Cabinet (the "Service"), operated by Bytehaven Pty Ltd (ABN 90 693 928 077). By uploading a file, generating a payment address, or downloading content, you agree to these Terms.
1. The Service
Upload Cabinet allows users to upload digital files, set a Bitcoin-denominated price, and receive payment from buyers in exchange for granting them access to download the file. Bytehaven facilitates the transaction by generating Bitcoin addresses and processing payments; we are not a party to the sale between the uploader and the buyer.
2. User responsibilities
2.1 Compliance with law
You must not upload or share any content that:
- Is illegal under Australian law (including but not limited to the Criminal Code Act 1995 (Cth) and state legislation);
- Infringes any third-party copyright, trademark, or other intellectual property right;
- Contains child sexual abuse material, terrorism-related content, or instructions for illegal activities;
- Contains malware, ransomware, or any malicious code;
- Depicts non-consensual intimate imagery.
2.2 Accurate representation
Uploaded files must be accurately described. Misleading or deceptive conduct in trade or commerce may breach the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law).
2.3 Prohibited uses
You must not use the Service to:
- Launder money or conceal the proceeds of crime;
- Evade sanctions or conduct transactions with sanctioned entities;
- Operate an unlicensed financial services business or digital currency exchange requiring AUSTRAC registration (if your activity exceeds the relevant thresholds, you are responsible for obtaining the necessary registrations);
- Harass, threaten, or abuse any person.
3. Fees
Bytehaven retains a platform fee equal to the percentage displayed on the upload page (default 10%) of each payment received. This fee is deducted at the time of payout. The fee is non-negotiable and subject to change with notice on the Service.
4. Payouts
If you provide a Bitcoin address at upload time, the balance less the platform fee is automatically sent to that address upon each successful payment. Bitcoin network fees (miner fees) are deducted from the payout amount. If no payout address is provided, the funds remain in the platform's wallet; it is your responsibility to request withdrawal.
5. Buyer rights
As a buyer, you are purchasing a digital file from the uploader, not from Bytehaven. Bytehaven does not guarantee the quality, accuracy, or legality of the files sold through the Service. If you have a dispute about a file, you must resolve it directly with the uploader.
6. Limitation of liability
To the maximum extent permitted by law, Bytehaven Pty Ltd is not liable for:
- Any loss arising from your use of, or inability to use, the Service;
- Loss of files, data, or Bitcoin private keys;
- Bitcoin price volatility or transaction delays;
- Any indirect, special, or consequential loss.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded by agreement.
7. No warranty
The Service is provided "as is" without warranty of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
8. Termination
We reserve the right to suspend or terminate access to the Service for any user who breaches these Terms, at our sole discretion, without refund of any fees paid.
9. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
